Terms of Service
1. Who we are
These terms cover OplyAI, a business of OPLYAI LLC (“OplyAI,” “we,” “us”), at oplyai.com. By using our website, calling our numbers, or buying our services, you agree to these terms.
2. Our services
- AI phone front desk. A voice agent that answers calls for a business, books on a connected calendar, takes messages, and transfers calls under the rules you set.
- Website chat, where your plan includes it.
- Website package. A launched site plus monthly maintenance, described on /sprint.
Plan details, prices, and what is included are on oplyai.com and in your order. The front desk plans do not include SMS or texting to your customers. Your agreement with us for a paid plan controls if it conflicts with these terms.
3. Using the service
You are responsible for the business information, call rules, and calendar you give us, and for using the service lawfully, including any notice or consent your callers need. The agent can make mistakes; confirm anything important with the caller. We may suspend use that is abusive, unlawful, or puts the service at risk.
4. SMS program terms
OplyAI LLC runs one text message program. It covers only (a) alerts to business owners about their own OplyAI service, such as a new message or booking taken by the agent, and (b) replies about a request to people who opted in to texts from us. We do not send marketing texts to your customers, and SMS is not part of client front desk plans.
- Opt-in. You join only by agreeing, for example by checking the optional, unchecked text box on our contact form at oplyai.com/contact, or by asking us to text you. Consent is not a condition of any purchase.
- STOP to cancel. Reply STOP to any message to opt out. We send one confirmation and then no further texts unless you opt in again.
- HELP for help. Reply HELP for help, or contact us at hello@oplyai.com or (831) 851-3416.
- Message and data rates may apply.
- Message frequency varies with your requests and account activity.
- Carriers are not liable for delayed or undelivered messages.
How we handle mobile numbers and opt-in data is in our Privacy Policy. Mobile numbers and SMS opt-in data are never shared with or sold to third parties or affiliates for marketing purposes.
5. Fees and billing
Fees are as stated on the site or in your order at the time you buy. Month-to-month plans renew until cancelled.
No refunds. Setup fees and monthly fees are non-refundable, including for partial months. We do not offer a money-back guarantee.
How to cancel. You can cancel anytime by emailing hello@oplyai.com. Cancellation takes effect at the end of your current billing cycle; you keep service until then and are not billed again after it.
Support. Email hello@oplyai.com for help. We aim to reply within 1 business day (Monday to Friday, 9am to 5pm Central, excluding US holidays). If your line is down or calls aren't being answered, put "OUTAGE" in the subject line and we aim to respond the same day, including weekends. We also monitor client lines every hour. These are targets, not guarantees, unless your signed agreement says otherwise.
6. Disclaimers and limits
The service is provided “as is” to the extent the law allows. To the extent the law allows, OplyAI LLC is not liable for indirect or consequential damages, and our total liability for any claim is limited to the fees you paid us in the three months before the claim.
AI accuracy. The service uses automated AI that can mishear, misbook, or give incomplete answers. You are responsible for reviewing bookings and messages. We don’t guarantee leads, bookings, or revenue, and the service is not for emergencies.
Recording notice. You agree not to remove the agent’s recording notice and to give any other notices required where you or your callers are located. Client agreements are governed by our Master Services Agreement and Data Processing Addendum.
7. Governing law
These terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law rules.
8. Changes
We may update these terms. The “Last updated” date at the top will change when we do.
